These Terms of Use (“Terms”) govern your access to and use of fitlizzy.com (the “Site”), operated by Fit Lizzy, LLC (“Lizette Ortiz,” “Fit Lizzy,” “we,” “us”). By visiting or using the Site, you agree to these Terms. These Terms apply to everyone who visits the Site, whether or not you are an enrolled client.

1. Relationship to Our Other Policies

These Terms govern the website itself. If you enroll in a Fit Lizzy, LLC Program, your coaching relationship is separately governed by our Client Service Agreement, Informed Consent & Disclaimer, Liability Waiver & Health History (PAR-Q) Intake Form, Cancellation & Refund Policy, Communication & Confidentiality Policy, and Testimonials, Photo/Video Release & Emergency Procedures Policy, each of which is incorporated by reference and governs to the extent it addresses a topic more specifically than these Terms. Our collection and use of personal information is governed by our Privacy Policy.

2. Eligibility

The Site and Fit Lizzy, LLC’s Programs are intended for adults. By using the Site, you represent that you are at least 18 years old.

3. Site Content and Intellectual Property

All content on the Site—including text, graphics, logos, the Fit Lizzy, LLC name and branding, workout frameworks, nutrition frameworks, and other program materials—is the property of Fit Lizzy, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and use Site content for your personal, non-commercial use in connection with your own participation in a Program. You may not copy, reproduce, distribute, republish, sell, or create derivative works from Site content, including workout or nutrition frameworks provided as part of a Program, without Fit Lizzy, LLC’s prior written consent.

4. Acceptable Use

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Site, its systems, or any related network.
  • Scrape, data-mine, or use automated means to access or collect content from the Site without our prior written consent.
  • Interfere with or disrupt the Site’s operation, or introduce viruses or other harmful code.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Submit false or misleading information through any form, booking tool, or contact feature on the Site.

5. No Medical Advice

General content on the Site, including any blog posts, articles, or educational material, is provided for general informational purposes only and is not medical advice. It does not create a coach-client relationship and should not be relied upon as a substitute for professional medical guidance. 6. Testimonials and Results

Testimonials, reviews, and example results that may appear on the Site are used with the individual’s consent, reflect that person’s own experience, and do not guarantee similar results for you. See our Testimonials, Photo/Video Release & Emergency Procedures Policy for more detail.

7. Third-Party Links and Services

The Site may link to or integrate with third-party services, including our payment processor (Square) and social media platforms. We do not control and are not responsible for the content, policies, or practices of any third-party site or service. Your use of a third-party service is governed by that provider’s own terms and privacy policy.

8. Accessibility

We want the Site to be usable by as many visitors as possible and are working toward alignment with recognized web accessibility guidelines. If you experience difficulty accessing any part of the Site or have suggestions for improvement, please contact us at lizette@fitlizzy.com so we can address it.

9. Site Availability; No Warranty

The Site is provided “as is” and “as available.” We do not guarantee that the Site will be uninterrupted, error-free, or secure, and we may modify, suspend, or discontinue any part of the Site at any time without notice.

10. Limitation of Liability

To the fullest extent permitted by Texas law, Fit Lizzy, LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site. This limitation applies to use of the Site itself; it does not limit or replace the separate liability waiver and assumption-of-risk terms that apply to your physical participation in a Program, which are addressed in our Liability Waiver & Health History (PAR-Q) Intake Form.

11. Indemnification

You agree to indemnify and hold Fit Lizzy, LLC harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your violation of these Terms or your misuse of the Site.

12. Dispute Resolution; Arbitration Agreement; Class Action Waiver

Please read this section carefully—it affects your legal rights. You and Fit Lizzy, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your relationship with Fit Lizzy, LLC will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court.

  • Class action waiver: You and Fit Lizzy, LLC agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, or representative action.
  • Right to opt out: You may opt out of this arbitration agreement by sending written notice to lizette@fitlizzy.com within [30] days of first accepting these Terms. Opting out does not affect any other part of these Terms.
  • Jury trial waiver: You and Fit Lizzy, LLC each waive the right to a trial by jury for any covered dispute, except where arbitration is opted out of as described above.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas. Subject to the arbitration agreement above, any dispute not subject to arbitration shall be venued in El Paso County, Texas.

14. Changes to These Terms

We may update these Terms from time to time. The version posted on this page at the time of your use governs. Material changes will be reflected by an updated “Last Updated” date above.
