Informed Consent & Disclaimer
Applies to all Fit Lizzy, LLC coaching tiers and The Upgrade wellness program
This Informed Consent & Disclaimer Policy (“Policy”) applies to every client enrolled in a Fit Lizzy, LLC (“Lizette Ortiz,” “Fit Lizzy,” “we,” “us”) program, including all three tiers of our flagship coaching program (Self-Guided Reset, Signature Coaching, and Elite Concierge) and The Upgrade wellness program (collectively, the “Programs”). By enrolling in a Program, you (“you” or “Client”) acknowledge that you have read, understood, and agree to this Policy.
1. Nature of Services — Not Medical Care
Fit Lizzy, LLC provides remote personal fitness instruction and health and wellness coaching, including workout guidance, general nutrition education, lifestyle strategies, and accountability support. Our services are educational and motivational in nature and are not a substitute for medical care.
Lizetter Ortiz is not a physician, registered dietitian, psychologist, or licensed healthcare provider. Nothing provided through any Program—verbally, in writing, or through recorded content—constitutes medical advice, diagnosis, or treatment. Fit Lizzy, LLC coaches are not licensed by the State of Texas to diagnose, treat, or provide medical nutrition therapy for any disease or medical condition.
Nutrition guidance provided as part of any Program is limited to general, non-medical wellness education (for example, sample evidence-based meal frameworks and habit-based strategies). It is not personalized medical nutrition therapy and is not a substitute for consultation with a licensed dietitian or physician, particularly if you are managing diabetes, hypertension, heart disease, disordered eating, pregnancy, or any other diagnosed medical condition.
2. Medical Clearance and Health Disclosure
Before beginning any Program, you must complete our Liability Waiver & Health History (PAR-Q) Intake Form and disclose all relevant health conditions, injuries, medications, and limitations. If you have a diagnosed medical condition, are pregnant or nursing, are over the age of 45 and new to exercise, or answer “yes” to any question on the PAR-Q screening, we strongly recommend you obtain clearance from a physician before starting. Fit Lizzy, LLC may decline or postpone enrollment until appropriate medical clearance is provided.
You agree to keep us informed of any change in your health status throughout your participation in a Program, including new injuries, diagnoses, medications, or pregnancy.
3. Assumption of Risk
Participation in fitness and wellness coaching involves inherent risks, including but not limited to muscle strain, sprain, joint injury, fainting, abnormal blood pressure, cardiovascular events (including, in rare cases, heart attack or death), and aggravation of pre-existing conditions. These risks may be heightened because Programs are delivered remotely, without an instructor physically present to spot, correct form in person, or respond immediately to an emergency.
By enrolling in a Program, you voluntarily assume all such risks. You acknowledge that your participation is voluntary and at your own risk, and that Fit Lizzy, LLC is not liable for injury, loss, or damage arising from your participation, except to the extent caused by Fit Lizzy, LLC’s gross negligence or willful misconduct, which cannot be waived under Texas law. Our separate Liability Waiver, which you sign before your first session, sets out these terms in full.
4. No Guarantee of Results
Fitness and wellness outcomes depend on many factors outside our control, including your effort, consistency, starting health status, genetics, and adherence to guidance. Fit Lizzy, LLC does not guarantee any specific weight-loss, strength, health, or appearance outcome. Any testimonial or example result we share reflects that individual’s own experience; results vary.
5. Right to Modify or Decline Services
Fit Lizzy, LLC reserves the right to modify, limit, or decline any exercise, workout, or coaching recommendation based on the health information you provide, your demonstrated ability, or safety concerns observed during a live session.
6. Emergencies
You are responsible for stopping activity immediately and seeking appropriate medical attention (including calling 911) if you experience chest pain, severe shortness of breath, dizziness, faintness, or any other concerning symptom during or after a session. Because sessions are conducted remotely, Fit Lizzy, LLC cannot physically intervene in an emergency.
7. Related Policies
This Policy should be read together with our Liability Waiver & Health History (PAR-Q) Intake Form, Client Service Agreement, Communication & Confidentiality Policy, Cancellation & Refund Policy, and Privacy Policy.
8. Governing Law
This Policy is governed by the laws of the State of Texas. Any dispute arising from this Policy shall be venued in El Paso County, Texas.

By enrolling in or continuing to use any Fit Lizzy, LLC Program, you acknowledge that you have read, understood, and agreed to this Informed Consent & Disclaimer Policy. A signed copy of this consent, together with our Liability Waiver & Health History (PAR-Q) Intake Form, is also required before your first session.
